The Client accepts without restriction and in full, without possibility of modification, to comply with the General Terms and Conditions of Sale and the Internal Regulations of the Hotel&Spa La Villa*** Sainte Maxime.
The General Terms and Conditions are governed by French law, without prejudice to any mandatory protective provisions that may apply in the country of residence of the consumers.
The Services booked by the Client, which include hotel room reservations and related services, will be provided according to the following terms and conditions, in accordance with these General Terms and Conditions of Sale, supplemented by the Rate Terms and Conditions of Sale, which the Client has read and accepted at the time of booking. Prior to any booking, the Client declares that they are acting for personal purposes and have the full legal capacity to enter into this agreement under these Terms and Conditions. The Hotel&Spa La Villa*** Sainte Maxime reserves the right to modify or supplement, at any time, all or part of these General Terms and Conditions of Sale. The only applicable version will be the one in effect at the time of booking by the Client on the website.
The French language version shall prevail. If the General Terms and Conditions are translated into a foreign language, the French language shall prevail over any other translation in the event of any dispute, litigation, difficulty of interpretation or execution of these terms and conditions and, more generally, concerning the relations existing between the parties.
All reservations constitute firm orders.
The client confirms their reservation by email, mail, telephone call, or in person. This reservation confirmation must be accompanied by a guarantee using a Visa, MasterCard, or American Express credit card; this list is subject to change. Hotel&Spa La Villa*** Sainte Maxime will confirm the reservation with the client by email. If the Client confirms their reservation by email, the entry of the required bank details and the acceptance of these General Terms and Conditions of Sale and the Special Conditions by electronic means constitutes an electronic contract between the parties; this electronic contract constitutes proof between the parties of the reservation and of the enforceability of the sums due in execution of said reservation.
In the event of failure to send the booking email, booking by email or if the Client confirms their booking by mail, telephone call or on site, the hotel's receipt of the required bank information as well as the acceptance of these General Terms and Conditions of Sale and Internal Regulations by return mail, on site, electronically (following a telephone call), constitutes a contract between the parties; this contract serves as proof between the parties of the booking and the enforceability of the sums due in execution of said booking.
All reservations are held until 9pm; beyond that the hotelier may make use of the reserved room(s) unless the client has notified the hotelier of a late arrival in writing or by telephone which the hotelier has accepted.
Upon arrival, the Client is required to present their identification to ensure compliance with the obligation to complete a Police Registration Form, as stipulated in the decree of August 18, 2015 (published in the Official Journal on August 20). This information will only be shared with the police and gendarmerie upon their request.
The prices quoted for accommodation are per room for the number of people and the selected date. Prices are expressed in euros, inclusive of all taxes, and in the establishment's local currency; they are valid only for the period indicated on the website. Tourist tax is not included in the price, unless otherwise stated on the website, and will be paid by the guest upon arrival at the establishment. Unless otherwise stated on the website, options such as breakfast, parking… which are not offered at the time of booking are not included in the price.
The rates quoted by the establishment in response to the Client's booking request are valid at that time and may be modified if the Client confirms their stay late for economic reasons. After the Client's booking is confirmed, rates may be modified in the event of legislative and/or regulatory changes likely to result in price variations, such as: changes in the applicable VAT rate, or the introduction of new taxes.
Types of rates and payment terms
FREE CANCELLATION RATE 7/14 DAYS: Our standard rate
Booking conditions: Free cancellation 7/14 days.
No prepayment will be required. Pay for the entire stay upon arrival.
A valid credit card is required to guarantee the reservation. The customer's card will be verified remotely.
FLEXIBLE PRICE 30%:
Booking conditions: Flexible 30% deposit. The booking is firm and final upon receipt of a valid credit card number for the payment of a 30% deposit of the total booking amount. The balance will be payable on arrival at the hotel.
NON-REFUNDABLE PRICE:
Booking conditions: Non-cancellable, non-refundable
FREE CANCELLATION RATE FOR 30 DAYS:
Booking conditions: Free cancellation 30 days in advance.
No prepayment will be required. Pay for the entire stay upon arrival.
A valid credit card is required to guarantee the reservation. The customer's card will be verified remotely.
The Customer provides their bank card details, either: Prepayment is required before arrival to guarantee your reservation and for remote check-in. Accepted credit cards: Visa, Mastercard, American Express. Cash payment is also accepted upon arrival.
In any case, if the Client has not prepaid their stay, they will be asked, upon arrival, for a security deposit or their bank card number for authorization to debit the bank card in order to guarantee payment of the sums corresponding to the services consumed and any damage in the establishment.
No payment terms are granted. Extras (additional rooms and/or nights, breakfast, parking, drinks, tourist tax, pets, etc.) consumed by the Client will be added to the final bill. Any late payment will incur late payment penalties equal to one and a half times the current legal interest rate without prior notice.
TOTAL OR PARTIAL CANCELLATION, RESERVATION MODIFICATION
If you need to cancel or modify your reservation after it has been confirmed, cancellation fees may apply depending on the conditions chosen at the time of booking:

You can cancel your reservation free of charge up to 7 days (for double rooms) 14 days (for suites) prior to arrival.
Furthermore, in the event of late cancellation or no-show, 100% of the total booking amount will be collected remotely from the customer.
FLEXIBLE PRICE 30%:
Cancellation policy: You can cancel your reservation up to 7 days prior to arrival for rooms / 14 days prior to arrival for suites. The 30% deposit will be retained.
Furthermore, in the event of late cancellation or no-show, the fees will amount to 100% of the total booking amount and the supplement will be collected remotely from the client.
NON-REFUNDABLE PRICE:
Cancellation policy: The total cost of the stay will be charged upon receipt of the reservation.
In case of cancellation, modification or no-show, the total cost of the stay is due.
FREE CANCELLATION RATE FOR 30 DAYS:
Cancellation policy:
You can cancel your reservation free of charge up to 30 days before arrival.
Furthermore, in the event of late cancellation or no-show, 100% of the total booking amount will be collected remotely from the customer.
All cancellations or modifications must be submitted by email. All modifications must be validated by reception.
In the event of an interruption of the stay or no-show, this will result in the total cancellation of your reservation and no refund.
In the event of a shortened stay, a delayed arrival date, a change in the number of guests, or any other event altering the original booking agreement, the full amount of the stay confirmed by the establishment before the modification by the Client will be charged, along with any additional costs incurred for the changes. The deposit paid will be retained and deducted from the final invoice.
ACCESS TO ROOMS
The reception is open from 7:45 am to 1:45 pm and from 3:45 pm to 9:45 pm (these hours may be subject to change depending on the season and events)
Rooms are available from 4pm and must be vacated by 11am.
Arrivals are from 4pm to 9pm; departures from 8am to 11am.
Early or late arrival can be arranged upon prior request to reception and subject to an additional charge according to the following scale:
• €50 for arrivals between 8am and 12pm
• €20 for arrivals between 12pm and 1pm
After 9 PM: Late arrival with self check-in can be arranged. The key card must be retrieved from a lockbox; the code, along with complete instructions, will be sent to the guest after we receive their ID. This late arrival is free of charge. However, if the guest calls us for assistance, a surcharge will apply: €20 between 9 PM and 11 PM; €50 after 11 PM.
A late departure can be arranged upon prior request and subject to an additional charge according to the following scale:
·€20 for a departure between 11am and 1pm
• €50 for a departure between 1 p.m. and 3 p.m.
• The cost of an additional night at the current rate after 3pm
If a late check-out or late check-in is not arranged with reception, a fee of €20 per hour of overstay will be charged. Any hour started is due in full.
BREAKFAST
Breakfast is served from 8am to 10am every day in the heated/air-conditioned room or on the terrace.
(Extended hours may be available free of charge upon prior request and subject to availability)

Breakfast consists mainly of fresh, local produce.
We kindly ask you to inform reception upon arrival or at the latest the day before by 9pm if you wish to have breakfast at the hotel.
All cancellations must be made at reception no later than the day before arrival. If cancellation is not made the day before, the hotel will charge the full amount of breakfast.
PARKING
We have several parking lots:
*Free private enclosed parking, located 500m from the hotel – valet parking service available for an extra €10
*Paid storage units inside the hotel (entrance dimensions: W2.2m x H2.2m): €20/unit/day
Several free public parking lots are located opposite and in the immediate vicinity of the hotel.
TOBACCO
Smoking is prohibited in the rooms and suites, including at the window. Only the terraces are designated smoking areas, and a supplement of €250 will apply.
We are a non-smoking establishment. Smoking and vaping are strictly prohibited on the hotel premises, including in guest rooms.
Smoking is only permitted on the terraces.
Application of Decree No. 2006-1386 of November 15, 2006, establishing the conditions for implementing the smoking ban in designated areas. We reserve the right to charge a €250 surcharge to any guest who has smoked in their room and to refuse them future access to the hotel.
We cannot tolerate these abuses, because beyond the inconvenience to our next customer, it leads to a complete cleaning of all the textiles in the room and a closure of the room for 2 days (hence a loss of business).
PEOPLE WITH REDUCED MOBILITY
Our hotel cannot be adapted for access for people with reduced mobility, as bringing it up to standard is currently impossible to do in the establishment.
The most accessible rooms are located on the garden level but with 1 step to climb.
Visual alarms are present in the establishment for people with hearing impairments.
RIGHT OF VISITATION
Visitors are only permitted after checking in at the reception desk. Rooms are designed for a specific number of guests. To ensure the safety of the establishment, you must not accommodate any additional people under any circumstances.
LINEN, CLEANING, ROOM USE
As an environmentally conscious hotel, guests are made aware of best practices: limiting water usage, etc.electricity, heating and air conditioning, participating in the sorting carried out by the establishment, choosing soft modes of transport, minimizing products in the room….
However, the customer can request a sewing kit, swimming cap, etc. at reception.
Rooms-Suites: bed linen and towels are provided.
For environmental reasons, only the towels on the floor are replaced. Bed linen is changed on average every 3 days.
The customer can specify their refusal or restrictions upon receipt.
Recycling (paper, cardboard, glass, metal) is available in the establishment: in rooms or in containers in the parking lot.
Do not use the towels from the rooms to go to the beach. Ask at reception for beach towels.
Do not flush anything down the toilet except toilet paper.
The hotel has a central heating and air conditioning system. However, guests can adjust the temperature individually or turn it off using the ON/OFF/TEMP buttons.
Please turn off the air conditioning when opening the windows.
For ecological reasons, the temperature in the room should not exceed 19°C in winter and should be less than 24°C in summer.

TELEVISION
The television offers channels in French, English, German and Italian.
Some programs on French channels may be available in foreign languages. To change the language using the remote control:

FIBER WIFI
Fibre optic Wi-Fi is free throughout the hotel, including in the rooms.
A personalized code, valid for the duration of your stay, is assigned to you and given to you upon arrival.
The client agrees not to use illicit computer resources and to refrain from any act that undermines the effectiveness of these resources, and to remain within the bounds of legality.
MINI-BAR
A minibar is available in the room. It includes:
· 8 Soft drinks €2.50
· 2 Craft Beers from Provence €5*
Guests are asked not to bring any foreign food or drinks into the hotel.
BAR, RESTAURANT
The hotel has a bar with a full liquor license. The bar is open from 8am to 1pm and from 4pm to 9pm.
We offer artisanal ice cream, hot and cold alcoholic and non-alcoholic drinks.
A must-try: our Provençal specialties.
Meals available by reservation: set menu (starter/main course/dessert)

VALUABLES and SAFE
The rooms and suites are equipped with a safe. The key can be collected from reception against a €20 deposit.
The hotel accepts no responsibility for lost or stolen items. Guests must ensure that the room is locked – door and window – before leaving.
ANIMALS
Animals are not allowed in the establishment.
With the exception, and subject to availability and agreement from management, in the 3 ground floor rooms, for an additional charge of €15 per (small) pet per day.
For hygiene reasons, animals are not allowed in common areas and in particular in dining areas.
SPA – WELLNESS AREA
The hotel has a wellness area. It consists of:
· A sauna with 2 reclining seats and 2 heating modes: classic thermal or infrared
• a 5-person therapeutic jacuzzi – 2 reclining and 3 seated
The spa operates by prior appointment at reception for private 1-hour sessions.
For 1 to 5 people, aged 16 and over.
Bathrobes, towels and slippers are provided.
The spa is open at the same times as the reception, from 8am to 1pm and from 4pm to 9pm, with defined time slots.
Customer price: 1-hour private session:
€30 for 1 person – €45 for 2 people – €20 per person for 3 or more people
A shower is mandatory before entering the wellness area.
The spa is disinfected between each group of users.
SPA INTERNAL REGULATIONS
1. It is always useful to remember that a spa is not a bathtub and that you do not wash yourself in it.
2. This space is based on rest and relaxation. Common sense rules will allow all users to enjoy themselves in a clean and pleasant environment: respect for the premises, hygiene and safety.
3. It is open by prior appointment with reception, from 8:30 a.m. to 12:30 p.m. and from 4:30 p.m. to 8:30 p.m. only by reservation and subject to availability.
4. Access to and use of this relaxation area is reserved exclusively for Hotel Guests.
Any exception to this rule requires the express agreement of the owners. Access is prohibited to children under 16 years of age, and to children under 18 years of age unaccompanied by an adult.
5. A shower is mandatory before entering the wellness area.
6. Five minutes before the appointment time, the client arrives at reception in bathrobes and slippers to be escorted to the spa where he will receive a quick briefing.
7. No entry to the room with street shoes: disposable slippers are available.
8. We kindly ask you not to use the bath towels for the spa. Towels are available in the relaxation area.
9. After using the jacuzzi, please place your towels in the designated basket.
HYGIENE AND SAFETY RULES
1. The outer door of the spa remains open for safety reasons in case of an alert.
2. The SPA is designed for 1 to 5 people.
3. You use it at your own risk: in case of damage to the equipment or use of soap in the SPA, the repairs of the damage will be at your expense.
4. It is not recommended to swim with any valuables. We accept no responsibility for physical or material damage, loss, theft, or alteration.
5. Hygiene:
– Shower in your room with soapy water to remove all traces of moisturizer and dirt,
– Long hair must be tied back,
– Appropriate swimwear and proper behavior are required.
– Creams, oils, exfoliants and any other products are strictly prohibited in the SPA.
6. Eating, drinking, chewing gum, smoking or vaping is of course prohibited.
7. It is strictly forbidden to use the SPA if you have skin lesions, plantar warts, etc., and it is strongly recommended that you shower once you return to your room and moisturize your skin.
8. Beware of drowning: leave the spa immediately if you feel unwell, dizzy, or drowsy. Hot water can cause hyperthermia and loss of consciousness. Using a spa in conjunction with alcohol, drugs, or medication can lead to loss of consciousness. Spa use can have varying health consequences depending on the individual. We urge users to exercise caution and consult their doctor about this practice. During pregnancy, spa use can be harmful to the fetus. If you have any health concerns (cardiovascular problems, diabetes, obesity, etc.), seek advice before using a spa.
9. Management reserves the right to exclude and prohibit entry to the Wellness area to any person whose behavior violates these rules.
10. Management reserves the right to close the relaxation area in the event of force majeure (poor bacteriological quality of the water, closure for maintenance, failure to comply with hygiene and safety instructions).
RULES for using the equipment
SAUNA:
1. The sauna door must remain closed

JACUZZI
1. The jacuzzi is a therapeutic jacuzzi
2. It has 3 seats and 2 reclining places: on the right, an ergonomic male position; opposite on the left, an ergonomic female position.
3. The intensity of the jets can be individually adjusted using the grooved buttons.
4. A remote control allows you to start and stop the jets. The jets operate on their own for approximately 17 minutes. You can stop and restart them at will using the remote control.
5. The remote control is waterproof; it can fall into water, but the customer is asked to place it in a dry place.
6. The two three-pronged buttons activate fountains.
7. The two buttons at water level should be used with care: they activate jets of water on the neck. These jets are warm and do not provide a massage. One turn is sufficient.
8. The customer must be vigilant when entering and exiting the spa in order not to slip.
LOST KEYS
During your stay, you will be given a card allowing you free access to your room.
In case of loss, you will be charged €10 for replacement.
PROTECTION OF PERSONAL DATA
Every person has the right to request to view, modify or delete their personal data upon simple written request.
In accordance with law 78-17 of 6 January 1978, it is noted that the personal data requested from the Client is necessary for the processing of their reservation and the preparation of invoices, in particular.
This data is processed and intended for the Hotel and may be communicated to its potential partners responsible for the execution, processing, management and payment of reservations as well as the Client's stay.
In addition, the Hotel may send its customers by email its newsletter, promotional offers, and a satisfaction questionnaire following their hotel stay.
In accordance with applicable national and European regulations, the Client has a permanent right of access, modification, rectification and objection with regard to information concerning him/her.
NUISANCES AND DAMAGE
Upon arrival, the guest is given a complete tour of the hotel and shown to their room. This tour serves as an initial inventory check, including verification of drinks, linens, cleanliness, and the overall condition of the room. In the event of any issues, the guest will be relocated to another room if the problem cannot be resolved immediately.
By making a reservation, the Client assumes full responsibility for all persons in their group.
The customer may not bring in any drinks or food from outside without prior authorization from management.
The client agrees to ensure that participants and their guests comply with all the establishment's rules and regulations (including the no-smoking policy). The client will ensure that participants do not disrupt the operation of the establishment or compromise the safety of the establishment or its occupants. Guests are asked to respect the premises, including the room's decor and common areas.
The customer may not bring in any outside beverages or food without prior authorization from management. A surcharge of €100 will be applied for violations, except in the case of kitchenette rental.
The customer must immediately inform the establishment of any damage they may cause. The Client will be held responsible for all direct and/or indirect, consequential damages caused by them, found in the reserved room or that they may cause within the Hotel. In case of any problem, the client may hold them liable.
Consequently, he undertakes to compensate the Hotel up to the amount of said damages, without prejudice to any damages that may be due, legal fees and attorneys' fees incurred by the Hotel.
All damage caused in the room, in the spa or in the common areas (corridors, spa, bar, hall, terrace, parking) by cigarettes, food, drinks or other, will be charged to the bank card provided by the client, with a minimum of €100 .
Any items missing from the room upon the Client's departure will be charged to the bank card provided by the Client, with a minimum charge of €50 .
Any behavior contrary to public decency and order will lead the Hotel to ask the Guest to leave the premises without any compensation or refund, even if payment has already been made. If no payment has yet been made, the guest must pay the full price of the stay before leaving the establishment. In the event of a serious breach, a complaint may be filed with the police.
The content of the Hotel's website is the property of the Seller and its partners and is protected by French and international intellectual property laws.
Any reproduction, in whole or in part, of this content is strictly prohibited and may constitute an infringement of copyright.
When the Client makes a reservation on the website, they are solely responsible for their choice of services and booking, and are also solely responsible for the information provided at the time of booking. The establishment cannot, therefore, be held liable in any way in this regard, nor for any erroneous or fraudulent information provided by the Client. Furthermore, the Client is solely responsible for any reservation made on their behalf and/or on behalf of third parties, including minors, unless they can demonstrate fraudulent use resulting from no fault or negligence on their part. As such, the Client agrees to indemnify Hotel&Spa La Villa***Sainte Maxime against all claims, actions, or legal proceedings of any kind and to compensate it for any related damages, costs, or compensation. In particular, by making a final reservation for a service, the Client agrees to pay the price and to comply with the applicable Special Conditions, as specified below: - Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the Client will result in the cancellation of the service reservation at the Client's expense, without prejudice to any action that the establishment may take against it.
Within the framework of an obligation of means, the establishment undertakes to provide access to the website and the services offered and to act diligently and competently, making every reasonable effort to remedy any malfunction brought to its attention. The establishment may nevertheless be obliged to suspend the website without prior notice, particularly for technical maintenance reasons, without incurring any liability. The Client acknowledges and accepts that the establishment cannot be held liable for any inconvenience or damage related to the use of the internet, such as: poor transmission and/or reception of any data and/or information on the internet. Failure of any receiving equipment or communication lines. Any malfunction of the internet network preventing the proper functioning of the website and/or the booking of services. The website may contain hyperlinks to other websites published and managed by third parties, for which the establishment disclaims all responsibility regarding the content of these sites and the services offered therein. It is specified that the partners are responsible for promoting the offers published on their own websites. The decision to consult third-party websites is therefore the sole responsibility of the Client.
The Parties shall not be held liable if the non-performance or delay in the performance of any of their obligations, as described herein, arises from a case of force majeure, as defined in Article 1218 of the French Civil Code. It is expressly agreed that force majeure shall suspend the performance of the Parties' reciprocal obligations and that each Party shall bear its own costs arising therefrom. The establishment may be released from its obligations or suspend their execution if it is unable to fulfill them due to the occurrence of a force majeure event, and in particular in the event of total or partial destruction of the establishment, strike…
In case of eviction:
In the event of an exceptional event, force majeure or impossibility of making the reserved room available to the Client, the Hotel reserves the right to relocate the Client to another accommodation within the hotel or to accommodate the Client, in whole or in part, in a hotel of equivalent category, for services of the same nature and subject to the Client's prior agreement.
These General Terms and Conditions of Sale, the Personal Data Charter, the Terms and Conditions of Sale of the rate reserved by the Customer, the Booking Request, the Booking Confirmation by the Customer, constitute the entire agreement between the parties within the limits of its purpose. They therefore replace and cancel, within this limit, any prior verbal or written agreement.
No tolerance, whatever its nature, extent, duration or frequency, shall be considered as creating any right and shall not lead to limiting in any way whatsoever the possibility of invoking each of the clauses of these General Terms and Conditions of Sale, at any time, without any restriction.
Any clause of these General Terms and Conditions of Sale which is declared null and void or unlawful by a competent judge shall be deprived of effect, but its nullity shall not affect the other stipulations, nor affect the validity of the General Terms and Conditions of Sale as a whole or their legal effects.
The Client will have a period of 8 days from his departure date from the Hotel to issue, in writing with acknowledgement of receipt, reservations or complaints concerning the provision of Services, with all supporting documents relating thereto, to the reception of the Hotel – 122 Avenue du Croiseur Léger Le Malin – 83120 Sainte Maxime.
No claim will be validly accepted if the Client fails to comply with these formalities and deadlines.
In the absence of reservations or complaints expressly made by the Client within this period upon receipt of the Services, these will be deemed to conform to the reservation, in quantity and quality.
All disputes arising from purchase and sale transactions concluded under these general terms and conditions of sale, concerning their validity, interpretation, execution, termination, consequences and subsequent effects, which could not be resolved between the Hotel and the Client, shall be submitted to the competent courts under the conditions of common law.
The Client is informed that he may in any event resort to conventional mediation, in particular with the Consumer Mediation Commission (Consumer Code art. L 612-1) or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.
